Company means Bell & Canvas, the supplier of the hired equipment.
Client means the person, business or organisation hiring the equipment.
Equipment means the bell tents, furnishings, beds, bedding, accessories and any other items listed on the invoice or booking confirmation.
Hire Charge means the total amount payable by the Client.
Hire Period means the period from completion of set-up until collection or dismantling of the Equipment.
A booking is only confirmed once accepted in writing by the Company and the required deposit has been paid.
The Client agrees to pay the deposit stated on the invoice. The remaining balance must be paid no later than 28 days before the hire date, unless otherwise agreed in writing.
The Company reserves the right to cancel or withhold delivery of Equipment where payment has not been received by the due date.
Late payments may incur interest and reasonable recovery costs.
The Client is responsible for:
Providing a safe, firm and level site suitable for the Equipment.
Ensuring suitable access for delivery vehicles and staff.
Obtaining permission from the landowner.
Arranging any permits, licences or approvals required for the event.
Providing clear information about underground services, pipes, cables or other hazards.
Ensuring the Equipment is used safely and responsibly throughout the Hire Period.
The Company will not be responsible for damage to underground services where accurate site information has not been provided.
The Client must ensure the site is available at the agreed set-up time.
If the Company is delayed due to lack of access, unsuitable ground conditions, incorrect information or any issue outside the Company’s control, additional charges may apply.
The Client must not enter or allow others to enter the Equipment while it is being erected or dismantled.
The Client must not:
Move, alter or tamper with the Equipment.
Attach, hang or suspend items from the tents without written consent.
Use heaters, cooking equipment, candles, fire pits, naked flames or electrical appliances inside or near the tents without written consent.
Smoke or allow smoking inside or within 3 metres of the Equipment.
Allow animals inside the tents without prior written approval, except assistance dogs where agreed.
Use the Equipment for any unlawful or unsafe purpose.
Tents must be kept closed and secured when not in use, especially in poor weather.
The Client is responsible for the safe custody of the Equipment during the Hire Period.
The Client agrees to pay for any loss, damage, theft, excessive soiling or misuse of the Equipment, including the cost of repair, cleaning or replacement where required.
The Client should inspect the Equipment after set-up and notify the Company immediately of any issue. If no issue is raised before use, the Equipment will be treated as accepted.
Cancellation must be made in writing.
Unless otherwise agreed:
More than 28 days before hire: the deposit is non-refundable.
Within 28 days of hire: the full Hire Charge remains payable.
If the event is cancelled, postponed or unable to proceed for any reason outside the Company’s control, the Client remains responsible for any agreed hire charges.
The Client is strongly advised to arrange suitable event insurance.
The Company shall not be liable for delay or failure to perform due to circumstances beyond its reasonable control, including storms, high winds, flooding, fire, transport delays, power failure, pandemic, government restrictions, site restrictions or any other force majeure event.
Where conditions are unsafe, the Company reserves the right to delay, alter or refuse set-up.
The Company will provide its services with reasonable skill and care.
The Company shall not be liable for loss of profit, loss of business, event cancellation costs, indirect losses or consequential losses.
Nothing in these terms excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot legally be excluded.
The Company’s total liability shall not exceed the total Hire Charge paid by the Client.
The Client is strongly advised to arrange insurance covering cancellation, damage, theft, public liability and any other risks connected with the event.
The Client remains liable for monies owed even where the event is cancelled or postponed.
The Client agrees to indemnify the Company against claims, losses, damage or injury arising from the Client’s event, guests, contractors or use of the Equipment, except where caused by the Company’s negligence.
These terms shall be governed by the laws of Scotland, unless otherwise agreed in writing.
Any disputes shall be subject to the jurisdiction of the Scottish courts.
